Terms and Conditions for prize draws by Quality First GmbH in the UK

1. Subject of the Terms of Use and Participation

1.1. Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany ("organiser") regularly organises prize draws ("prize draws") on its Instagram account morenutrition.uk ("Instagram presence") to promote its products.

1.2. The prize draws organised by the organiser on Instagram presence are in no way connected to Meta Platforms Inc. and its affiliated companies and are not the responsibility of, sponsored, supported, or organised by Meta Platforms Inc. and its affiliated companies. All questions, comments, notes, and complaints about prize draws should be directed to the organiser and not to Meta Platforms Inc.

1.3. These terms and conditions regulate the conditions for participation in the prize draws as well as any necessary transfer of rights.

2. During what period can I take part in the prize draw?

2.1. The participation period for each prize draw is determined by the participation period published on Instagram presence.

2.2. A prize draw typically lasts around two (2) days, and winners will be notified within three (3) days after the prize draw.

2.3. The organiser reserves the right to extend the participation period by providing appropriate notification on Instagram presence. If the participation period is extended, the further handling of the prize may change accordingly.

3. Who can participate in the prize draws?

3.1. Any natural person who is at least 18 years old, resides in the United Kingdom, and has their own Instagram account ("participant") can participate in the prize draws published on Instagram presence.

3.2. Each participant is only entitled to enter the same prize draw once. Participation by the same person using different social media accounts is prohibited and entitles the organiser to exclude the participant from the prize draw. Additionally, only individuals who have not previously won a prize may participate.

3.3. By participating in the prize draw, the participant accepts these terms and conditions.

4. How does participation in the prize draw work?

4.1. Participation in the prize draw is free of charge and is exclusively governed by these terms and conditions.

4.2. A prerequisite for participation in the prize draw is following the organiser's Instagram presence.

4.3. If additional requirements for participation in the prize draw are necessary (e.g., liking, sharing, commenting, or reposting the post), the organiser will communicate this when publishing the respective prize draw.

4.4. Only participants who meet the conditions mentioned in Sections 3 and 4 at the time of the draw will be considered for the prize draw.

4.5. After the participation period ends, the winner ("winner") will be determined by the organiser among all eligible participants. The winner will be chosen randomly.

4.6. The winner will be notified via an Instagram direct message from the organiser's Instagram presence.

4.7. Each notified winner must confirm acceptance of the prize within seven (7) days by providing their first and last name, email address, and postal address.

4.8. If it is not possible to contact the winner, or if the organiser does not receive a corresponding message within the period specified in Section 4.7, the opportunity to claim the prize expires, and the organiser reserves the right to select another participant and notify them accordingly.

4.9. If the winner provides incorrect or false contact details (e.g., email address or postal address), the organiser is not obliged to determine the correct data. Any disadvantages arising from incorrect contact details (e.g., undeliverable prizes, returns, etc.) are the responsibility of the winner.

5. What are the prizes?

5.1. The prizes are determined by the prize draw published on Instagram presence. Generally, vouchers or non-cash prizes ("prizes") are raffled.

5.2. Vouchers (or voucher codes) will be sent via email, and non-cash prizes will be sent by the organiser to the winner's residence, as specified in Section 3.1.

5.3. A cash payout, exchange, or transfer of prizes (both vouchers and non-cash prizes) is excluded for all prize draws.

5.4. The organiser is only liable for damages suffered by the winner due to material and/or legal defects in the case of fraud, intent, or gross negligence. Otherwise, liability for material and/or legal defects is excluded.

5.5. Winners are responsible for any potential taxation of the prize.

6. Who can be excluded from the prize draw?

6.1. Any violation of these terms and conditions entitles the organiser to exclude individual or multiple participants from the prize draw. This applies in particular if false information is provided or third-party rights (such as personal or copyright rights) are violated.

6.2. Additionally, the organiser may exclude individual or multiple participants from the prize draw if the participation process and/or platform is manipulated or an attempt to manipulate is made and/or if these terms and conditions are violated, or if there is any unfair or dishonest attempt to influence the prize draw or its handling, especially through disruption of the software used. In such cases, prizes may also be revoked and reclaimed retrospectively.

6.3. Persons who do not meet the conditions stated in Sections 3 and 4 are excluded from participation.

6.4. Employees of the organiser or an affiliated company, as well as other individuals involved in the development and execution of these prize draws, are excluded from participation.

7. Early Termination, Adjustment, or Modification of the prize draw

7.1. The organiser is entitled to terminate, adjust, or modify the prize draw at any time without prior notice and without giving reasons if proper execution of the prize draw cannot be ensured due to technical or legal reasons without appropriate measures.

8. How is my data processed?

8.1. The organiser processes participants' data exclusively for the purpose of conducting and handling the prize draw in accordance with Article 6(1)(b) GDPR. The data provided as part of the prize draw will be deleted – subject to legal retention obligations – if the purpose for processing these data ceases to exist or they are no longer required for that purpose. Participants may revoke their consent to data processing at any time.

9. Severability Clause

9.1. Should individual provisions of these terms and conditions be invalid or become invalid, the validity of the remaining terms and conditions shall remain unaffected.

9.2. Legal recourse is excluded.

9.3. These terms and conditions are subject to German law, unless mandatory provisions of the law applicable at the participant's habitual residence, particularly consumer protection regulations, take precedence.
